Terms of Service

1. Service Description

Rooted is a family coordination application designed for parents and guardians. The Service enables you to manage schedules, track goals and milestones, store documents, record expenses, and coordinate caregiving responsibilities for your dependents (children and pets). The Service includes both free and paid subscription tiers.

Rooted is intended for use by adults (18 years of age or older). The Service is not directed at or designed for use by children under the age of 13.

2. Account Registration

By creating an account, you represent and warrant that:

• You are at least 18 years of age.
• The information you provide is accurate and complete.
• You will maintain the security of your account credentials and promptly notify us of any unauthorized access.
• You are responsible for all activity that occurs under your account.

3. User Responsibilities

As a user of the Service, you agree to:

• Use the Service only for its intended purpose of family coordination and dependent management.
• Provide accurate information about your dependents and keep it up to date.
• Respect the privacy of other family circle members and use shared information responsibly.
• Comply with all applicable laws and regulations, including those related to the privacy and protection of minors.

4. Photo Upload Terms

By uploading photos of dependents to the Service, you represent and warrant that:

• You have legal authority to upload photos of the depicted dependent as their parent, legal guardian, or authorized caregiver.
• You have provided explicit consent through the in-app consent flow before uploading the first photo.
• The photos do not contain inappropriate, harmful, or illegal content.
• You understand that photos are used solely as profile avatars within your family circle and are subject to the safeguards described in our Privacy Policy.

We reserve the right to remove any uploaded photo that violates these Terms without prior notice.

5. Prohibited Uses

You may not use the Service to:

• Upload, store, or share content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Impersonate any person or entity, or falsely represent your relationship to a dependent.
• Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems.
• Use the Service for any commercial purpose, including advertising, marketing, or solicitation.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use automated systems (bots, scrapers, crawlers) to access the Service.
• Upload photos of individuals without the legal authority to do so, or upload photos of anyone other than your dependents for avatar purposes.
• Interfere with or disrupt the integrity or performance of the Service.

6. Intellectual Property

The Service, including its design, code, logos, and documentation, is owned by Rooted and protected by intellectual property laws. You retain ownership of all content you upload to the Service (including photos, documents, and profile information). By uploading content, you grant us a limited, non-exclusive license to store, display, and process that content solely for the purpose of providing the Service to you and your family circle.

This license terminates immediately when you delete the content or your account.

7. Subscription & Payments

Rooted offers both a free tier and a paid subscription (Rooted+). Paid subscriptions are billed monthly or annually as selected at the time of purchase. You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. We reserve the right to modify pricing with 30 days' notice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Rooted and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use of or inability to use the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Indemnification

You agree to indemnify and hold harmless Rooted and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users, us, or third parties. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately, and we will delete your data in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Delaware.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email at the address associated with your account and update the "Last updated" date at the top of this page. Your continued use of the Service after such notification constitutes acceptance of the updated Terms.
